By creating an account on 1199 you accept these terms and the privacy policy. If you only look at public trees without an account, they also apply to you where relevant.
1. Who runs 1199
In accordance with the European e-Commerce Directive (2000/31/EC) and article 3:15d of the Dutch Civil Code (Burgerlijk Wetboek), the owner of 1199.es is:
- Owner
- Diego Mesa Marrero, trading as 1199.es (sole proprietorship, eenmanszaak)
- Address
- -
- hola@1199.es
- Registration
- Netherlands Chamber of Commerce (Kamer van Koophandel), KvK number 92671772
- VAT
- NL004969641B04
2. What 1199 is
1199 is a site for rebuilding your family tree and telling its story: people, relationships, photos, maps, a timeline and posts written together. Every tree is private until its owner decides to open it, and within each tree every person can be public or private.
3. Your account
- You must be at least 16 years old.
- An account belongs to one person. Use an email address that is yours and give true details.
- Keep your password safe: whatever is done from your account is your responsibility. If you think someone has got in, change it and let us know.
- If you invite others to your tree, you decide what they can do (read or edit) and you can remove their access whenever you like.
4. What you upload is yours
The data, texts and photos you upload remain yours, and you can take all of it with you whenever you like. For 1199 to work, you give us permission to store them, copy them (in backups), adapt them (for example, making thumbnails of photos) and show them to whoever you have chosen. Nothing else: we don’t use them for anything else and we don’t give them to anyone.
Whatever you mark as public can be seen by anyone, can be found by search engines, and other accounts can add those people to their own trees within 1199. If you don’t want that, mark it as private.
Only upload photos and texts that are yours or that you have the right to use. An old family photo is usually fine; one from a book, a newspaper or a website usually isn’t.
5. Other people’s data
A tree is full of people who haven’t opened an account. When you upload data about them, you agree to:
- have the permission of the living people you add, or of their parents if they are minors, especially before making them public or tagging their face in a photo;
- never make public data or photos of minors. On 1199, anyone born less than 18 years ago is always private: they can be seen by the members of their trees and by whoever has the password of one of those trees, and this cannot be changed. If you don’t enter their date of birth, mark them as private yourself; and don’t upload photos showing a minor to the public gallery;
- not publish anything that harms their honour, privacy or image, including people who have died;
- not upload data about the health, religion, sexual orientation, ethnic origin or political opinions of living people without their explicit consent;
- delete or correct whatever you are reasonably asked to.
You are responsible for what you publish about others. We provide the means to hide or remove it, and we remove it when we are told about it.
6. What is not allowed
- Uploading anything illegal, or content that harasses, threatens, discriminates against or impersonates anyone.
- Downloading trees or people in bulk and automatically, or reusing them outside 1199 without the permission of whoever added them.
- Trying to get into places you shouldn’t, guessing passwords, overloading the website or getting around its limits.
- Using 1199 to send advertising or spam.
- Using the messages between accounts to harass, deceive or ask for money or personal details, or to write to people about anything unrelated to their family and their tree. If someone doesn’t reply, don’t keep insisting.
If someone does, we may remove that content and, if it is serious or happens again, close the account. Unless it is urgent or the law prevents it, we will tell you beforehand and explain why.
7. Telling us about something that shouldn’t be there
If you see something that breaks these terms, the law or your rights —a minor, data about you or your family, a photo of you, something false or offensive—, use the “Report” link at the bottom of every page, or write to us at hola@1199.es with the link and the reason. You don’t need an account. It reaches us straight away, we look at it soon (anything about minors, first) and, if you leave us a way to reply, we tell you what we have done.
A message that bothers you is reported from the conversation itself, where you can also block whoever sent it. Only then, and to resolve it, can support read that conversation.
8. Plans, purchases and payments
The free plan costs nothing and doesn’t expire. Paid options are on the pricing page, with their amounts, which include VAT (the rate that applies in your country; if you are a business in another EU country and give your VAT number, without VAT and under the reverse-charge mechanism). Payment is made through Stripe, which is who receives your card details; we never see them. You receive the receipt and the invoice by email.
- Plans (Family and Genealogist). They are paid in advance, monthly or yearly, and renew automatically at the end of each period until you cancel them. You can cancel whenever you like from your account (“Manage subscription”): the plan carries on until the end of the paid period and is not renewed. If you move to a bigger plan, you pay the difference for the time left; if you move to a smaller one, the change starts in the next period. If a payment fails, we retry it for a few days; if it still fails, you go back to the free plan.
- Withdrawal. You have 14 days from taking out a plan to withdraw without giving any reason, with the “Withdraw from the contract” button in your account: we cancel it on the spot and refund the part of the payment you haven’t used.
- Single prints. A purchase is for that print of that tree. For 7 days you can correct it and download it again as many times as you like; whatever you download stays in “My purchases” for good. When you buy it you ask to download it straight away: when you download it in high quality for the first time, you lose the right to withdraw from that purchase (it is digital content); as long as you haven’t downloaded it, you can return it from “My purchases” within those 14 days.
- The family book. Designing it and downloading a sample (with the 1199 watermark) is free. The print-ready PDF comes with the yearly Family plan and with Genealogist, for as long as you have them. Without a plan it is bought with “Everything + book”, which is for that book and the three prints of its tree: for 7 days you can correct it and make it again as many times as you like, and whatever you download stays in “My purchases” for good. When you buy it you ask to have it straight away: when you download the print-ready PDF or a print in high quality for the first time, you lose the right to withdraw from that purchase; until then, you can return it from “My purchases” within those 14 days.
- Prices. If we ever change the price of a plan, we will tell you by email at least 30 days before it applies to your next renewal, and you can cancel before then.
If a paid plan ends, we don’t lose anything of yours: you go back to the free plan with everything you had (whatever doesn’t fit in the free plan stays saved; you just can’t add more).
9. Leaving
You can leave whenever you like, from your account (“Your data and your rights” → “Delete my account”). First we tell you what happens to each thing, and it is deleted on the spot:
- Your trees are deleted, along with the people who were only in them, except the ones you decide to give to someone who already has access to them: those become theirs.
- What you added to other people’s trees (people, photos, posts, biographies) stays there, without your name: it is already part of their tree.
- Your plan: if you are within 14 days of taking it out, we withdraw it for you and refund what you haven’t used; if not, it is cancelled at once, without a refund for the rest of the period.
- Your payments are kept for 7 years without your name or your email, because tax law requires it; the files in “My purchases” are deleted.
Before you leave, or whenever you like, you can take a copy of everything that is yours with “Download my data”, in your account, on any plan. Everything else is as explained in the privacy policy.
If 1199 ever closed down, we would give at least 60 days’ notice so you can take everything with you.
10. Liability
We do our best to keep 1199 always working and to never lose anything, but we can’t promise there will never be a fault or an interruption. Keep your originals: paper photos and the files on your computer are worth more than any copy on the internet.
We are not responsible for what other people publish, nor for the data in a tree being true: genealogy is often wrong. None of this limits the rights the law gives you as a consumer, nor our liability in cases of intent or gross negligence.
11. Changes
If we change these terms, we will put the new date here. If the change is important, we will tell you by email at least 15 days in advance; if you don’t agree, you can leave before it applies.
12. Governing law
These terms are governed by Dutch law. If you are a consumer, that doesn’t take away the protection given to you by the law of the country where you live, and you can take any dispute to the courts there. Before it comes to that, write to us: almost everything can be sorted out by talking.
These terms and the privacy policy are written in Spanish. This English version is a translation to make them easier to understand: if the two say different things, the Spanish version applies.
